Legal Question in Discrimination Law in Virginia

Laid off when eligible for retirement

Today I was given a layoff notice. I am fully vested and eligible to retire. What recourse do I have for a firm trying to end my employment so they do not have to pay retirement?

Re: Laid off when eligible for retirement

If you are fully vested and eligible to retire, then your firm is obligated to pay you whatever retirement benefits which you have earned to date,

even if you're terminated, unless there is some exclusionary provision for cause which would also allow them to avoid paying your benefits, if, for instance, you had been convicted of a crime in connection with your employment such as embezzlement, theft, fraud, etc.
