Age children should do things for themselves

My step son will be 9 in June this year. His mother still washes him and shares a bed with him when he visits on weekends. We have told her this isn't ok and that she could get into trouble for it. She refuses to listen and says she isn't doing anything wrong. Which of us is correct? Can she get into trouble for washing him (he specifically mentioned his backside) and sharing a bed with him? He showers himself and sleeps along when he is with us and has his own bedroom at her apartment.

The mother's alleged doings with respect to her 8.5 year old son are not what would be normally recommended,

but, if that's all that's going on (and nothing more), the CPS(Child Protective Services) folks need not yet be summoned.
