what evidence is needed to prove this in court

This is not exactly a family law question but one rather involving crimes and offenses found in the Virginia Criminal Code. I no longer see

what used to be characterized as "buggery" listed among these crimes, and, therefore, it would appear no longer to be a prosecutable offense in the Commonwealth.
