child visitation

i wanted know where to start, about getting visitation rights to see my two children in virginia. i pay support on my own will. she just won't let me see my kids unless i'm dealing with her. the city she lives in is called suffolk, virginia. my kids mom and i went our separate ways about 3 years ago and she still is not over it, therefore she won't alow me to see my kids. please help me i'm desparate.

If there is a prior custody or visitation order you go to the court that issued it. If not you go to the Suffolk County Juvenile and Domestic Relations Clerk's office. If there is a prior order you file a MOTION TO AMEND. If not an original petition. You ask for visitation rights. You may not deserve much letting so much time go by but you have to start somewhere. And - very important - hire a good lawyer. Quality representation makes a very large difference here.

You can file a petition with the Suffolk Juvenile & Domestic Relations District Court to establish your visitation rights with your children. You don't need a lawyer for this but, nevertheless, you may still want to consider consulting an attorney in the Suffolk area who is knowledgeable in Virginia family law matters and who will be able to advise you not only on your visitation issue but also should be able to answer any questions you may have on related matters.
