Legal Question in Family Law in Virginia

My divorce was finalized in 2009. As part of my divorce, we were supposed to sell the marital property and split the money. My ex husband and 2 of my children live in the house rent free. It is paid off. And, they are not paying rent in lieu of me paying alimony. My father died a couple of months ago and I am not in a position to buy my ex out of the house. The real estate appraiser would like to know if the house should be appraised for current value or it's value at the time of the divorce? Thank you.

I see no reason as to why you would want to accommodate your former husband's apparent delinquency

in failing to follow through with his part of the divorce in selling this house back in 2009 (as well as living rent free there apparently ever since) by allowing for an appraisal of this property at a much lower price reflecting its value during the housing crisis of 2008-10, so I would therefore advise appraisal at

the current price (even if I'm wrong about your ex's suspected "delinquency").
