husband commited adultry disappears for day refuses divorce and wont move out what are my rights and how do i go about divorce

If you have credible proof of your husband's adultery, that alone is a so-

called fault ground which would enable you to immediately file for divorce rather than await the elapse of a year apart continuously, and without cohabitation for the more common no fault divorce (unless of course the conditions for divorce after six months were to apply).

If you're now determined to initiate divorce proceedings, you should consult an attorney knowledgeable and experienced in Virginia domestic relations law who should be able to advise you, accordingly.
