Hi.

My Daughters husband deserted her and two 2 small children yesterday for a girlfriend. He took the check book and atm cards, went to the bank and withdrew all the money knowing there were checks outstanding for car payment, utilities etc. The account is in botih names. What can she do?

How does she persue charges?

Thanks You.

Charges, what charges? If your daughter's husband was a joint holder on the accounts along with her, he was legally entitled to "clean 'em out", which he apparently did.

Your daughter's task now will be to get a pendente lite petition filed in the appropriate circuit court which will award her temporary support and custody of the children and sole possession of the family home and with, perhaps, an additional order requiring her absconding spouse to rectify his disproportionate grab of the assets in the joint accounts by giving back at least half of what he summarily took for himself(and his girlfriend).
