Legal Question in Family Law in Virginia

I have joint custody of my 15-year old child with my ex. He has physical custody. He is using drugs, lost his job and house and got rid of all the child's belongings to get money for drugs. He has also lost his driver's licenses, and the police are aware of his drug activity, He told his family to take the child or send her back to me. She came back to me and wants to stay with me. He is now threatening to come get her. What do I do?

Based upon these material changes in circumstances which, presumably, either did not

exist or the court was not aware of when it entered its last custody order, you could now

repetition for full custody of this child with a decent chance of winning your case if

the allegations you've mentioned can be proven by a preponderance of the evidence.
