Legal Question in Family Law in Virginia

I live in Virginia. My husband and I have been seperated since April 2012. He wants to file a joint tax return. Will filing jointly delay the length of time we have to live appart when filing for divorce? I am also receiving food stamps because he no longer lives in the home. Will filing jointly affect my award?

There is no formal support agreement. I have primary custody of the 5 children

Filing a joint tax return will not affect the separation timing, nor should it affect your receiving food stamps. However, if you have custody of 5 children you should be receiving child support from him.
