Legal Question in Family Law in Virginia

If I was married but separated not legally for two years and I have a child with someone else and the bio father signed the birth certificate which I know now he should not of who is considered the father and has rights. The biological father is letting my current husband of 4 years adopt our son but who has to says it's ok my ex husband or the child's father?

Neither, it's the judge of the circuit court who will be in charge of hearing this proposed step-parent adoption who will have the final say in the matter.
