Visitation & Support

In the State of VA is there a such thing as ''if the ncp parent has the children for 90 days out of the year that the support could be reduced? and if so does this include the scheduled visitation (i.e. every other weekend, scheduled holidays, 2 weeks in summer)

Re: Visitation & Support

If more than 90 days, the shared custody support will be cacluclated for each parent based upon the percentage which each has of the total gross monthly income for both, as outlined in Va. Code Sec. 20-108.2G3(a).

The time frame at issue in this matter includes all time that the parent has the child on a regular basis which, of course, includes all scheduled visitation as well as partial days which include overnight stays and which are counted as one half days to each parent for the purposes of the 90 day calculation.
