Legal Question in Medical Leave in Virginia

Visitation

My husband and I aren't divorced yet, but we are separated. He wants to take our two year old for the weekend and he says he has a court order. But we didn't go to court together. Is it possible that he have a court order for visitation if we haven't gone to court.

It is possible to have a temporary court order put in place until there is a more formal hearing, just to bridge the gap. However, it does not sound to me like the sort of thing that a judge would order on a temporary basis, without your involvement, especially for a husband to take a two-year old child from a mother. It is remotely possible but rather unlikely. I think you should certainly demand to see a copy of the court order.
