Legal Question in Civil Litigation in Virginia

Can in-laws do this?

A young friend was married 9-2-06. On 9-18-06 her husband and is 18 year old brother were killed in an auto accident. Both were cremated. After the memorial service my friend took her husbands ashes. Her in-laws said they were going to sue her because she took their sons ashes. Can they do this and win?

Re: Can in-laws do this?

No, they cannot win such a suit. The wife has priority in the law over her in-laws in her right to claim her husband's remains and dispose of them as she sees fit.
