Legal Question in Civil Litigation in Virginia

Puppies I purchased were sick and the breeder will not refund my money

I purchased 2 puppies from a breeder, with a health guarantee, and about two days later they became sick and were diagnosed with parvo. I was unable to contact the breeder, and discovered he had lied to me to get me to pick up the puppies 5 days earlier than planned. On my vet's advice, I chose to euthanize the puppies. When I finally reached the breeder, he concluded the puppies had contracted the disease in my care, which is impossible, and he refuses to refund my money or replace the puppies. My vet believes they contracted the disease before I picked them up. What, if any, action can I take against the breeder?

This would appear to be a case well suited for small claims court. If your vet could come to court to testify on your behalf, that would be

very good for your case. In the event, however, that he cannot, his affidavit giving his opinion as to when the dogs contracted the parvo would be

a good substitute.
