Legal Question in Civil Litigation in Virginia

My roommate stole from me

My former roommate took some possesions from our apartment when we moved out that belonged to me. She also owes me some money on the electric bill, along with money that I gave her for the rent that she didn't pay. I don't have receipts for everything except for the electric bill. How can I ensure that i get my money? I have also heard she is trying to sue me for something I don't have but she claims I do. Is there any way to prove that I don't have it or is it basically whoever the judge believes?

Re: My roommate stole from me

The simplest way for you to proceed would be to

file a claim in small claims court for the

amount of money which you believe you are owed

including the fair market value of your property.

If she answers your suit and appears, you could then ask the judge for an order for the return

of your property as well as a judgment for the amount of money which she owes.

If she fails to appear, then ask for a default monetary judgment to cover everything.
