Legal Question in Civil Litigation in Virginia

State Education Responsibilities

Do states have a responsibility to provide ''equal'' educational opportunities at the high-school and college level?

For example, in my state, the high-schools run from dirt-poor to some of the best in the country. Since I, through no fault of my own, got stuck at a ''dirt-poor'' high-school, my educational and career opportunities are now quite limited.

So the question is, why have I been discriminated against within the public education system and what is the remedy for this?

I have spent almost every dime I have ever earned attempting to upgrade my education and I find myself 32 and broke after being subjected to the chains of rural ignorance for 20 odd year.

Re: State Education Responsibilities

The theory to which you've alluded, i.e, the states have a constitutional reponsibility to provide their citizens with "equal" educational opportunities, as measured as a pratical matter in terms of more less equal per capita spending on students, equipment, and facilities, has already had several runs through various federal courts in one version or another of the one outlined above.

None (to my knowledge) has yet to be ultimately upheld at the final appellate level as binding federal law in any of the federal circuits in which

this issue has been litigated.
