Legal Question in Immigration Law in Virginia

Asking Again

I asked this question before but I was not clear and the responses from the kind attorneys did not help. I have an A-3 visa type until Thursday 9/15/05. The Ambassador I used to work for has resigned his post and I have already been furnished with a letter terminating my employment as of 9/15/05. My I-94 (or the stab in the passport indicating arrival departure records)expires end of 2006. But given that my employment ends on 9/15/05, it does not matter. I have no status as of 9/16/05.

My citizen husband has petitioned for my green card and we have just been approved by INS. We are going to proceed with the green card application as soon as you help us answer this question below.

What does this mean to my legal (immigration) status here in the states? Am I breaking the law by staying in the country until I process my approved green card application? Will the immigration people penalize me for being in the country after 9/15/05. Should I live the country immediately or what should I do? Please advise.

Re: Asking Again

It appears that you may be technically out of status as of 9/15/05, and are therefore in the US illegally. However, the USCIS likely may not take steps to remove you from the country because your adjustment of status is pending. This is not legal advice.
