Legal Question in Immigration Law in Virginia

Hello,

I have been charged felony in Apr'2011, as I crossed department store with a jacket on my shoulder, while I was on phone, with out intention to steel.

I went to court and looking into this, court believed that it was by a mistake I crossed the store and no prior convictions.

Judge gave disposition to Guilty with Trespassing (misdemeanor)

So final judgment is Guilty with Trespassing(Misd) in VA.

I recently got new job and planning to go for H1B stamping to US Consulate in Canada.

will there be problem/issue at visa interview or while returning back to US??

Any recommendations/thoughts please?

If you only have one misdemeanor, you might not have any issues at the Consulate. However, without reviewing the court dispo & knowing more about your background, I cannot give you any guarantees.You will also need to bring a copy of the court disposition with you to the non-immigrant visa interview.

However, I highly recommend you discuss this with the Attorney who filed your H-1B before you depart the U.S.
