Legal Question in Insurance Law in Virginia

Car Accident

Dear Law Guru,

I was in a fender bender a month ago. I was pulling into the parking space, no cars around me was pulling out. All of a sudden, I see her big car backing out towards me. I stopped and honked my horn, but she kept going and hit me. I asked for her insurance but wouldn�t give it to me. I then said then I will have to call the police, that�s when I proceeded to Rite Aid to call the police. The police took the statement and asked us to call the insurance. My insurance wouldn't help me because they claim I only have liability and would have to work it out with hers. Her insurance declined my claim after a month based on what she only said,which didn't make sense, they didnt' investigate my car. Do I have any other recourse I can take? Thank You.

You can sue her for the damage to your car. Her insurance company will defend her, and if you can prove her liable, it will pay the judgment.
