Homeowner's Insurance

a friend of ours ran into my girlfriend's car with his moped, while her car was parked in our driveway. He was leaving, and I guess passed out from his blood pressure. My girlfriend says she'll sue my parents' home owners insurance if the other guy's insurance doesn't pay enough to cover the complete repair of her car to ''perfect'' condition (her car is only about a year old). The guy had the moped in our driveway as well, but ended up in the culdesack. Can she sue the homeowner's insurance when the homeowner was not at fault for the accident? The other guys insurance has been contacted, and is pending the adjuster to take a look at the car.

Homeowners insurance will not cover this. The homeowners were not negligent. The moped rider is liable, and his insurance should cover it; if not, your girlfriend's own insurance will have to cover it (and can pursue the moped rider for reimbursement).
