Legal Question in Employment Law in Virginia

As a new hire in November, I had signed up for health insurance for myself and my 7 month old daughter. It had been a few weeks and I never received my insurance card. I called to check and was told there was an issue with my I-9 form and that I was out of my new hire 30 day enrollment period and would not receive health insurance until 2014, and that I should just try "not to step off a curb and break my ankle" before then. I called back and eventually got the issue resolved and was told my health insurance would be effective immediately (this was December 5). Well, it's the 27th and still no insurance, even though a premium was deducted from my last paycheck. I've paid out of pocket for a doctor appointment for my sick infant. I've not taken my anxiety medicine because I can't afford it without insurance, and for the same reason I can't refill my birth control, or even schedule an appointment to talk with my doctor. I've got post-partum anxiety and this insurance ordeal is making it worse. They have me driving 60 miles a day to my training location and I'm in tears afraid of getting in an accident. I'm thinking about pressing charges. Do I have a case? All the calls to my HR department were recorded.

Pressing charges for what? (None of what you've described involves anything criminal on the part of your employer in my opinion.)
