Legal Question in Employment Law in Virginia

We are at a restaurant.

We put a tip on the receipt of $3.65 after we left the waitress changed the top to $10.00 and forged my wife's signature.

The next day I called and then went in and talked to the manager and he said that she told him that we signaled with our hands that she should change it. We never did this.
