Retainer Refunds

Are unused retainers paid to law firms generally refundable when it is determined the firm's services will not be required?

Yes, in Virginia (to the extent it is unearned); elsewhere, it may depend on the terms of the retainer agreement.

In New York, the unused portion of the retainer must be refunded if the attorney is discharged.
