Bit on a piece of bone in burger

I bit down on a piece of bone (1/16 to

1/8th inch size) inside of a chicken burger

I bought at Trader Joe's. Owner of

company in CA who makes patty for TJ

has submit claim to their insurance

company. One tooth has an abscess,

maybe adjacent tooth as well. Owner of

company does not want to be contacted

anymore and Insurance company is

being coy and asking for purchase

receipt and bone I bit on. This happened

8.21.08, I don't have the piece. I am

asking for dental work for two teeth to be

paid for, approximately $5,000. What can

I do to get the money to pay for the dental

work and go on with my life?

Sue the local Trader Joe's in small claims court which sold you the defective burger for your claimed damages of up to $5K.
