Legal Question in Personal Injury in Virginia

Am I liable???

I was wondering if i would be liable for an injury that occured in my house in the following situation: My son has some friends over and they are wrestling on his wrestling mat; on kid slams another kid breaking his arm, however; there is a sign on the wall stating ''wrestle at your own risk''. Am I liable?

First of all,if you have not already done so, notify your homeowner's insurence company about this accident at once. It may be a covered incident under one of the policy provisions.

The sign on the wall is of no help as to any liability issues.

Generally, you are not liable, as the parent, for the torts of your child. There is some question however, depending upon the facts of the situation and the age of the children involved, about your duty of supervision of them under the circumstances involved. Without more facts however, I am at a loss to opine further. Just make sure you notify your homeowner's insurance company.
