Legal Question in Personal Injury in Virginia

Medical records for car accident

I was in a rear end accident, the insurance company is asking for me to sign a release of 5 years worth of medical bills for my claim. Is that normal? Can I obtain the bills that pertain to the accident myself and give them copy?

Re: Medical records for car accident

I am not sure what you mean by a release of 5 years worth of medical bills for your claim.

I assume that you are saying they want you to give them permission to SEE your medical bills for the last 5 years, and your medical records.

Although they will try to use those medical records against you, including perhaps dishonestly, if you were to sue in court you would very likely have to release this information.

They are looking for any evidence that you were NOT injured originally in the accident, but you already had some or all of the injuries BEFORE the accident.

So they are definitely looking for evidence to avoid paying you and to defeat you.

But mroe than likely you will have to give this information.

Nevertheless, these are tricky situations and an attorney could help you avoid some of the dangers in this situation.

Yes, you should certainly be able to obtain copies of your own medical records and forward

copies of those to the insurance carrier which will meet their requirements.
