Legal Question in Product Liability in Virginia

boat sale responsibility

i sold a boat about 2 weeks ago. i told the seller it had a new engine on it- what i meant by new was a different one than was there before (the old one was cracked, so it had to be replaced). he understood a new, out of the box engine. i also explained to him before purchase that the engine had no warranty left on it. we went to the lake the next evening for a test run, and everything was fine- no issues at all. 4 days later, he called me to inform me the engine was basically falling apart. he found a piece of metal at the prop that turned out to be an exhaust flapper, said it had no power, made noise (squeal), leaked water. he started tearing things down to find a sealed crack on the side of the block that was seaping water. he asked for his money back, and i explained to him that when he took the boat, there was no warranty, and it ran flawlessly for 4 days. i offered to split the cost of a fix or rebuilt engine w/ 1-yr warr, and he declined, wanting a new engine. he said he would see me in court. i feel the backflow from the missing flapper (that apparantly broke after the purchase) damaged the engine internally, and at the weaker points the most (an old repair). i had no idea this replacement engine was in this condition

Re: boat sale responsibility

So, see the gentleman in court(presumably small claims) and tell your side to the judge.
