Breach

My RE agent is talking to sue for her commission after I breached a home purchasing contract. The contract did state I will be responsible for her commission if I default. But after further review, I noticed she back dated the termination date which reads as if this contract terminated 9 months ago. Can she still sue?

Of course, she can sue. Whether the agent can win her case, however depends upon the validity and enforceability of the contract which is unlikely to be be rendered neither invalid nor unenforceable by what may be a clerical type of error such as the one you've mentioned.
