Legal Question in Real Estate Law in Virginia

I have a covenant that states"made this 1st day of October, 1997" Do the parties have to be owners by that date, or can new owners sign until the document is actually recorded?

As long as there was a legitimate owner of the subject property as of that date

and who authorized or agreed to said covenant, little else likely should

matter ((in my considered opinion).
