Remedies Against Sellers After Purchase of Home

We purchased our home in June 2000. At the time, it was 3 years old. It had passed a visual inspection. Recently, we have noticed nails popping out of the roofing shingles and the seams on the vinyl siding are becoming more pronounced. Insurance adjuster stated this was a workmanship issue and to approach contractor for possible solution. Spoke with Seller who finally admitted that her brother-in-law, a contractor, put the roof and the siding on, and are denying that there are any problems, even though they are quite visible. I've tried to have the contractor/brother-in-law look at the problem to try and work out a solution, but both he and the Seller are not cooperating. Do I have any recourse/remedies? There was no ''as is'' clause written in the purchase of this house, even though that is what the Seller has attempted to suggest. How should I proceed?

If neither the contractor nor seller is cooperating, it's time to see an attorney in your area who practices in the area of real property law and who will outline the various options available to you.

From your description of the situation, it would appear that the seller failed to disclose information regarding a major defect in the structure which she was aware of at the time of the sale and, which by law she had a duty to inform you of prior to the completion of the transaction.
