Legal Question in Traffic Law in Virginia

can you be arrested in Virginia for not having car insurance? my girlfriend is adament that you can be. i looked on the department of motor vehicle's site and it stated you can either pay a $500 unisured motorist fee and drive at your own risk, or if you are caught driving without insurance you loose your license until you get insurance and pay a $500 reinstatement fee. But she is still adament you go directly to jail if caught.

No, what is involved here is a civil infraction or violation rather than a criminal

offense and therefore anyone allegedly in violation of these posted DMV regulations cannot be subject to arrest or other remedies of the criminal justice system but rather the civil penalties that are outlined on the DMV website as referenced in the above question.
