Legal Question in Traffic Law in Virginia

I was rear ended while sitting in a line of stopped cars in Virginia. I was not hurt at all, but my older model car was totaled as I was pushed into the car in front of me. There is no way I can purchase a comparable car for the amount I am getting. Is there any way to recoup the cost of purchasing a car without suing? Am I at risk of being sued by the person in front of me? Do I need to be injured to sue and if I did what would that entail?

#1 No, and even if you were to sue and win, you would be

unlikely to recover in damages anything more than the fair market value of

your vehicle at the time it was "totaled", i.e, its "Blue Book" (n my opinion).

#2, No, probably not, but more relevant facts may be needed to opine

on this issue with greater certainty.

#3 No, you don't need to be injured to sue, but if answer #1 is accurate, you'd probably be wasting your time (in suing).
