Legal Question in Wills and Trusts in Virginia

My brother and I inherited a home equally, it is paid off ,there was no will and all final bills are paid. He is executor and says that he has all say so over the real estate. He wants to rent it out to someone that I don't approve of. I want to rent it to someone else. Can he legally do this if I refuse?

Yes, he could do it but you could challenge it in court as an equal co-owner

of this property.

Looking down the road, so to speak, your differences are very likely more than

just the one referenced in your question, and therefore one of you would likely

be well advised to buy out the other's interest in the property in order

to obviate future conflicts between the two of you involving this property.
