Legal Question in Workers Comp in Virginia

My workers compensation doctor has signed a return to work form but I paid for my own second opinion who said I should not return to work. Will my workers comp case be dropped or closed if I don't return to work?

Once your authorized treating physician (the workers' compensation doctor) releases you to return to full duty without restrictions, then your compensation payments can be stopped even if you don't go back to work. Workers' compensation does not have to consider your second opinion except under specific unusual circumstances. It would be best for you to take your second opinion to your authorized doctor and discuss it with him or her. It is also important to know if you have an Award Order from the Virginia Workers' Compensation Commission. If you have any questions you should consult with a qualified Virginia workers' compensation attorney as soon as possible.
