speeding ticket from officer in opposite direction

so the other night, about 1am, i was in 5 lanes of traffic, 2 in each direction and a turning lane, the speed limit was posted 35 and i was doing 40 at the most. the road was a fairly large bend, and rather dark, and the officer came from around the corner, i naturally slowed down a touch, he u-turned and followed me for about..a quarter mile, and pulled me over. he asked for my lisense registration and insurance, i gave them to him, he told i was doing 49 in 35. i did not respond and he said he would be back, sit tight. he returned told me he was going to give me a ticket for doing 49 in a 35 and told me about my options then returned all my information and ticket and said thank you for your cooperation and returned to his car. do i fight this or not?

I would recommend timely contesting the infraction. The instructions are pre-printed on the back of the ticket.

Contesting the ticket will give you the opportunity to discover the evidence against you. Then you will be in a better position to decide what to do. Good luck.

You admit to speeding

The posted speed limit is for the maximum speed in good traffic conditions. One AM likley is not good traffic condition because of the darkness.

You write that "i was doing 40 at the most" which is above the posted limit in any case.

You can contest the citation. However, you need to find a good explanation of why you were doing 40 in a 35 zone at night.
