Non-compete agreements must be narrowly tailored, which means just broad enough to protect the employer's legitimate interests. Courts will especially look at geographic limitations and the duration of the prohibition against competing. Trade secrets are also protected even absent non-compete agreements if the employer can show that the information qualifies as a trade secret.
