Legal Question in Criminal Law in Washington

Deficient Attorney Performance

My son who is 25 was charged with felony assault on 2 EMT's. It did not happend the way these EMT's said. My son pleaded not guilty, got a Public Defender. We gave him a list of witnesses. He had list almost a month, didn't start working on the case until the week before trial. Prosecuter told my son's attorney they had a solid case and offered him a deal. His attorney told him to take an offer or possibly spend 8 months in jail. This attorney called 2 of the witness on Thursday, (trial following Monday). Both said he didn't do it. He was then pressure into pleading guilty. Changed to 4th assault, 12 days jail time, $700 in fines, 180 community service and to get an evalutation and 2 years probation. This is all wrong. We had the witnessed, but his attorney didn't bother to do his job. Can he do anything at this point as for ''Withdrawal of Plea'' as this attorney's performance was not only unprofessional, but unjust. Any ideas or information would really be of help. Thanks

Re: Deficient Attorney Performance

You should contact an attorney in your area who handles criminal law to see if he can help your son withdraw his plea. This can be difficult to accomplish.
