Legal Question in Entertainment Law in Washington

Publishing of adult artbook

I'm planning to publish an artbook of coloured drawings, some of which are mature in content, on the internet using a print-on-demand service.

The service provider does not give out guidelines for the content, instead stating that it will accept anything that is legal to publish in ''mainstream'' channels (high street publishing) according to US law.

I understand artistic nudity at least is legal, however where the line goes after that is unclear. I would assume that the fact the content is drawn and not photographic makes a difference of some sort. Some of the content would include sexual situations of varying degrees of explicitness.

Where can I find a complete description of what kind of mature visual content is legal to publish in such channels?

Re: Publishing of adult artbook

You can't. Supreme COurt Justices have struggled with the definitions of obscenity, prompting one Justice to state: I can't define it, but I know it when I see it.

These materials need to be reviewed on a case by case basis by your attorney (preferably one experienced in 1st Amendment law.) Good luck.
