Legal Question in Family Law in Washington

Change of Venue/Jurisdiction

My divorce and custody/support was in CA. Three years ago I moved to WA. My ex no longer lives in the county where the divorce took place.

I want to modify the child support. In the future I would like to modify the visitation.

Is it in my benefit to change the venue to WA? How expensive would it be? What are the steps?

Thank you.

Re: Change of Venue/Jurisdiction

California child support and Washington child support are calculated differently, and I don't know the details of California support, except that there is no cap. Washington currently has a cap, but it is not absolute. If neither of the parents reside in California, and one parent (with the child reside in Washington the case can be transferred into Washington Courts through the registration of the judgment with the Clerk. The filing fee is $220.00, and you need to provide original (certified copies of documents from the other State's courts) and a copy of everything you are registering to the clerk (for service). There are specific documents you need to file, and they must include specific information in them.

If money is an issue for you, please consider contacting the Family Support Division of the Pierce County Prosecutor's office.

They can help you with this, and they don't charge you for it. Hope this helps. Elizabeth Powell
