Legal Question in Family Law in Washington

Child support order modification

Our child support order was done in 1994 & was set at $25 per month because the father was not working. He is pretty much up to date on the payments but throughout the last 10 yrs I have been supporting our daughter on my own. I recently filled out the papers to change our order because $25 is not enough. Before I could send them in I got a letter stating that he has filed for bankruptcy and listed me as a creditor. What rights do I have in pursuing support from him for the last 10 + years or at least for the next few years before my daughter turns 18? She is 16 now & I don't think it's fair that he hasn't had to give more support. He is not working but is perfectly able to work. I am a single mom too.

Re: Child support order modification

Child support obligations cannot be discharged in bankruptcy.

Moreover, your child is about to go to college. You can ask the court to order the other parent to pay post secondary education support for your child.

There is no reason to delay filing the paperwork for the modification of child support and to ask the court to set the post secondary education support.
