husband apoting daughter, wat rights does the father have

my daughter is 4 and her biological father has never seen her and doesnt want to, he is not on the birth certificate or any legal papers. do i have to have him consent to the adoption? i have no idea where to look for info..he is in prison on nevada

You will want to get his consent and waiver to adopt. The court will press you about who the father is and if you acknowledge that you know, the court will demand it. If you perjure yourself and say you don't know who the father is or where he is, if the father changes his mind about wanting to be involved with the child and shows up and you don't have his consent and waiver, you will wish you did. Get the consent and waiver now while he doesn't want anything to do with the child.
