Legal Question

Green Card

Dear Sir/Ma'am,

I am holding a student visa and I have been living in the US for six years. I got my BA degree from a US university and am still in the process of completing my master degree. I was thinking if I am eligible to apply for a green card. If so, is there any other ways besides through a formal job offer? Please advise.

I agree with Bobby Chung that a possible "National Interest" waiver is one option where an employment offer is not needed. We did one where helping "at risk" youth was considered in the national interest.

Under the employment immigration categories, you may be exempt from the job offer requirement if you (1) possess Extraordinary Ability and have achieved International or National recognition in your field of expertise OR (2) your work involves significant benefit to the United States Economy, Society, etc. (known as the National Interest Waiver). Other immigration options include Investment Immigration, Family-Based Immigration (through Spouse, Parent, Son or Daughter, or Sibling), Asylum, or Diversity Visa Lottery.

You should consult a qualified immigration attorney to determine your green card eligibility.
