Disclosure regarding class B water system in Spokane County

Is the developer of a small group of homes, in Spokane County, using a class B water system required to disclose evidence of low pH and elevated copper levels in the water upon the sale of the homes? The homes were built with copper pipes and the copper levels in the homes are exceeding the state's acceptable standards due to the corrosive nature of the water caused by the low pH. Half the homes in the development were sold after the problem was identified and no such disclosure was made. Since the copper levels in some homes are as high as 5.3ppm and the state suggests that over 1.3ppm is not acceptable, most families in the neighborhood are now buying bottled water. There is no evidence of copper at the well head and the state currently has no regulation regarding pH.

Developer is required to provide to buyer Seller's Disclosure Form. No penalty if developer fails to provide, except buyer can rescind purchase and sale until three days after closing.
