time limit to issue a traffic citation

My son was stopped by a State Patrol going 79 in a 55 zone. The officer said he would ''Mail'' him a citation. The citation was finally mailed 6 weeks after the incident. My son (16) was too freaked out to ask any questions. Is there a legal time limit for the citation to be issued?

As most things in the law, it depends. If your son signed the ticket, the office (1) has to give him a green copy of the citation, (2) and has 48 Hours to file the ticket with the Court.

However, assuming the ticket was issued "under investigation" the officer has 365 days to mail the ticket to your son and file it with the Court.

Unless your son signed the ticket at the time of the stop, in which case the infraction must be filed within 48 hours of the date of issuance, excluding weekends and holidays, the officer has one year to issue the infraction. How the matter will be processed through the courts depends upon many factors, i.e., what court you are in, your son's license type (intermediate or normal), what type of speed measuring device was used, etc. If your son is under 18, and he receives two infractions, he wil have his license suspended for six months or until he is 18, which ever comes first.
