Is it better to file bankruptcy when filing for divorce or is it better to struggle and try to pay bills?

Your question cannot be answered without a lot of information. The most that can be said is that a married couple is eligible to file a joint bankruptcy with some cost savings even though they are separated and intend to divorce. If there is a separate filing, a spouse who ends up paying more than his or her fair share as per the divorce agreement can go in to the bankruptcy court to complain about the inequity. It is best to consult a lawyer, tell him or her all the details and make a decision based upon that advice.
