Legal Question in Family Law in West Virginia

Child Nearing 18 Wants Custody Change

I will be 18 on November 5, 1999. I will also be a senior in high school. I would like to live with my grandmother and go to a different school. School starts in August but my custodial parent says I cannot do this. Do I have any legal options?

I'm only licensed in Tennessee, so you should also check with a local attorney, but in most states you could petition the court to be emancipated for the limited purpose of allowing you to determine where you should live. Your parents could oppose it, but if the judge decided after hearing both sides that it was a good idea, than the judge could allow it.

Good luck
