The Statute of Limitations in a motor vehicle accident in West Virginia is two years. Suit must be brought and the parties served to toll the statute. Ordinarily, a lawyer would evaluate who the defendants may be, what additional service may be required (ie the underinsurance carrier) and other factors to be sure there is no forfeiture.
