Legal Question in Medical Malpractice in West Virginia

I want to know whether I am sued?

2 Years ago I came to know through my colleague that I was also involved in a malpractice case. However the case was voluntarily dismissed by plaintiff before I was formally served ( I never received from court). Now I am filling out forms for my new malpractice insurance company. I want to know how to respond If the question asks whether I have ever been sued?

One of my malpractice attorney said that I never been sued since I never served from the court.

I appreciate your advice. Thank you for your help and time.

I would strongly err on the side of prudence and tell the ins co that you understand you were sued, never served and the pliantiff did not pursue the case. Better to tell now then to explain to your children later why you don't have coverage for the next claim.
