Legal Question in Credit and Debt Law in Wisconsin

My husband died in 2010 . I never received a bill for the emergency services that responded when he died. A few months after his death I called the hospital that he had been taken to and told them I had never received a bill for anything. I was told that I was not responsible for anything because my husband did not leave behind an estate. Now a bill from a collection agency came in my husbands name requesting payment for some of the medical services. Should I ignore the bill or send it back stating that he was now deceased and there was no estate?

Any time that you ignore collection activity, you risk have adverse credit reporting against you, legal judgments, or potential bank account garnishments or other asset seizures. You should hire an experienced debtor attorney to dispute this debt for you now, before it is presumed to be valid. Hospitals can also file liens against real estate for their services.Under the WI Marital Property Act, his debts are enforceable against his 1/2 of your assets, including your home, retirement accounts, etc.
