Legal Question in Family Law in Wisconsin

Custody of disabled children and Joint Legal custody

I have been served papers to appear in court to deal with visitation and because my autistic daughter`s father wants to acquire joint legal custody. The reason for this action stems from the fact that I did not send my daughter for her visitation(the visitation is set up strictly between us-nothing in writing). The reason I did this, right or wrong, was because her father wasn`t implementing what is called a PECS communication system nor willing to follow a very strict diet (Gluten-free and Casein-free) after lengthy discussions. He did not show up to be trained in the Pecs and my daughter is to see an allergist for food sensitivities/allergies in July. My daughter is thriving because of this intervention and I wanted to stress how important that it be carried out at school, my home, therapies, and at his home. We have a show cause hearing tomorrow. I want to know, since I don`t have time to attain a lawyer through legal-aid, if there is anything I can do to show the importance of this. I know that I may not withhold visitation, but he is extremely unreliable and has made my 4 1/2 yr, old wait for 6 hours or longer for his arrival.

Re: Custody of disabled children and Joint Legal custody

The strict diet and classes requirements should be included in any order entered to show your concerns. Request a 30-60 day review date to see whether ex is complying and have an attorney appointed for the child - named Guardian ad litem. Obtain letter from M.D. to show to court re requirements.

Good luck,
